Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of the sayoliver.ai website, the Oliver AI practice-call demo, and related communications and content (together, the “Service”) provided by Oliver AI (“we,” “us,” “our”). By accessing the Service you agree to these Terms. If you do not agree, do not use the Service.
The Oliver product application at app.sayoliver.ai is governed by a separate customer agreement that takes precedence over these Terms for authenticated product use.
The Service
The Service is a marketing website and a self-serve practice-call demo. The demo lets you have a short voice conversation with an AI partner that simulates a buyer, customer, or other role; it then generates a transcript and a coaching scorecard. The demo is offered free of charge and is provided for evaluation and learning purposes only.
Eligibility
You must be at least 16 years old, capable of forming a binding contract under the law of your jurisdiction, and not barred from using the Service under applicable law. By using the Service in a business capacity, you represent that you are authorised to do so on behalf of that business.
Acceptable use
You agree not to:
- Use the Service to break the law or infringe anyone's rights.
- Attempt to reverse-engineer the Service, extract underlying models, scrape data at scale, or interfere with our infrastructure or security controls.
- Submit personal information about third parties (including real customers) into the practice call without their permission.
- Use the Service to generate or distribute content that is unlawful, harassing, defamatory, deceptive, or otherwise objectionable.
- Misrepresent your identity, the identity of the company domain you submit, or any other information you provide.
AI-generated content
Practice-call audio, transcripts, scorecards, and coaching feedback are generated by AI systems. They may contain errors, omissions, or content that does not accurately reflect best practice in your industry. You are responsible for evaluating the suitability of any AI-generated content before relying on it. The Service is not professional advice and is not a substitute for training, coaching, or legal, financial, or compliance review by qualified individuals.
Intellectual property
We retain all right, title, and interest in the Service, including the marketing content, scenarios, and underlying software. You retain ownership of the information and audio you submit. You grant us a worldwide, non-exclusive, royalty-free licence to host, process, display, and otherwise use your submitted content for the purpose of operating, improving, and securing the Service.
Privacy
Our handling of personal information is described in our Privacy Policy, which is incorporated by reference into these Terms.
Disclaimers
The Service is provided “as is” and “as available”, without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not warrant that the AI-generated content will be accurate, complete, or suitable for your particular circumstances.
Limitation of liability
To the maximum extent permitted by law, neither Oliver AI nor our affiliates, officers, employees, agents, or licensors will be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or in connection with the Service. Our total aggregate liability arising out of or relating to these Terms and your use of the Service will not exceed one hundred New Zealand dollars (NZ$100).
Indemnity
You will defend, indemnify, and hold harmless Oliver AI from and against any claims, damages, and expenses (including reasonable legal fees) arising out of your use of the Service, your submitted content, or your breach of these Terms.
Termination
We may suspend or terminate your access to the Service at any time, with or without notice, for any reason — including breach of these Terms or to protect the integrity of the Service. You may stop using the Service at any time.
Changes
We may update these Terms from time to time. Material changes will be reflected in the “Last updated” date above. Continued use of the Service after a change means you accept the updated Terms.
Governing law and disputes
These Terms are governed by the laws of New Zealand, without regard to its conflict-of-laws principles. The courts of New Zealand have exclusive jurisdiction over any dispute arising out of or relating to these Terms or the Service, except that we may seek injunctive relief in any competent jurisdiction to protect our intellectual property.
